U.S. National Mining Association Files Law Suit Against EPA and Army Engineers

The National Mining Association (NMA), representing the interests of mining industry in the U.S., filed a law suit Tuesday against the U.S. Environmental Protection Agency (EPA) and the Army Corps of Engineers, claiming the agencies are "unlawfully obstructing permitting of coal mining operations" in Central Appalachia.

The law suit filed in the U.S. District Court of the of Columbia charged the agencies with jeopardizing thousands of jobs and the vital supply of fuel to meet the nation's electric power needs. The NMA lawsuits accused the EPA and the Army Corps of Engineers of illegally preventing the mines in the region from obtaining water quality permits.

About 235 pending permit applications have been held up by the EPA for additional scrutiny since 2009. NMA President Hal Quinn mentioned that since member's efforts to navigate this unlawful process and obtain reasonable and predictable permit terms have been unsuccessful there was no option left but to challenge them in court. There was no comment from the EPA.
